Role of Law in Society

Creeping Socialism

Creeping socialism is the unfortunate new way by which the age old freedom of men of wisdom and understanding to lead, is lost. Instead every decision can be challenged by law. These laws are made by the government to please the majority. Every decision made by bosses, governments, military leaders, is judged by lawyers, who scutinise it by these laws that the community wants, because it does not trust those in authority. But more than half the people have an IQ of about a hundred or less, and are not sufficiently wise to know which choice is best. The people best able to make decisions are firstly, the most intelligent and experienced, that is superiors, and secondly, those closest to the action, that is the superiors themselves, not lawyers from outside.

Solomon writes: Woe to thee O Land when thy king is a child . . . blessed art thou O land when thy king is the son of the nobles. God wants a free world, where people can be trusted with personal responsibility. Crime should be punished by the law, the crime of hurting others and pornographic vice. The law should not seek to regulate every aspect of human behaviour.

Matters of Heart

The trend for increaingly more matters to be 'solved' by law is not as good as it seems, as the law is not good at dealing with the heart. Perhaps an angry word would in many cases would be better. Solomon says, Open rebuke is better than secret love. But today this can be punished by the law.

In most cases of sexual harassment, it would be better if the woman poured a can of soft drink over the man, shaming him, while the other women laughed at him. Men can think that they are God's gift to women, who should want them as much as they want them. Women need to teach men how they feel, and learning this from a book, is not as complete as learning it from a woman.

Laws need to be changed to give women more freedom to express their opinion. Although if true, for Tiger Wood's wife to hit him with golf clubs, would obviously have been wrong, he seems to have been a good man and have forgiven her. After all he is not perfect himself. A better example is to act like Hillary Clinton who is reported to have punched Bill Clinton after his misdemeanor with Monica Lewinski. I am sure that this did Bill Clinton good and no real harm, as men are tougher and stronger than women. Men who honour their wives by giving them important work are still not perfect, as all men need to be humbled.

The purpose of law should be to protect the weak. We do not want a society where the law is exalted unnecessarily, by investigating claims contradicted by the character of the accused, as if women who are harassed and cared about it, would wait until the man was rich or famous to complain. If powerful people do not have at least this measure of protection, they cannot make unpopular decisions and function effectively.

Criminal Law (so called)

Jesus said: Woe unto you, lawyers! ye have taken away the key of knowledge. (Luke 11:52) So lawyers are dishonest. And Jesus also said, Woe to you also, ye lawyers for ye lade men with burdens grievous to be borne. (Luke 11:46) They like to get heavy sentences. This makes them feel successful.

The exaltation of the legal process itself can be an imposition in terms of time and cost. They were always asking Jesus questions, such as whether taxes should be paid to Caesar, in the hope of using his words against him. But he was too clever for them. They watched him to see if he would break their thoughts about the law, and heal on the Sabbath. The point I am making is that the law can be used wrongly. No wonder Jesus said: that which is highly esteemed among men is abomination in the sight of God.

And if there is not enough evidence the person should go free. If every crime had one hundred per cent conviction rate, what place would there be for conscience. On the Day of Judgement every man's protestation that he was a law abiding citizen, would be counted for nothing, because the Devil would just say, You only kept the law because you knew you would be caught if you did not.

The hypocrisy of law is seen by its treatment of prostitutes. The reason that prostitution is not good, is that a woman deserves something better than for her privacy to be invaded and her holy place defiled. But the law sometimes seeks to please God by making it even worse for prostitutes, by publicly humiliating them and locking them up.

Trial

The role of the defense is to ask the easy questions. The role of the prosecution is to ask the difficult questions. The defense and prosecution each must show the possibility of innocence or guilt respectively, in the answers. It is not the role of either defense or prosecution to weight the probability of innocence or guilt by being clever in the way that they ask those questions or interpret those answers.

To encourage honesty lawyers should all be employed by the government, or perhaps if this is not adequate being paid from a common pool paid into by those who are tried. Lawyers salaries and promotion should not be dependent on results, but on IQ tests, educational advancement, experience, and hours worked, the latter only to a limited degree.

Surveillance

Now whilst we understand that the military must use surveillance, surveillance should not intrude upon the daily lives of civilians. There should not be security cameras in every shop. There should be more policeman.

Men are powerful and intrusive and pragmatic, and make decisions that on balance seem good even though there may be some disadvantages. Whilst these qualities make them good leaders, if they are good, men can also be oppressors. Women are more gentle, and less likely to upset people. They are nice to have around. In particular a man's desire to get results, and lower emotional sensitivity, can make surveillance operations by men, more unpleasant and damaging than surveillance by women, who are more patient.

Also for reasons of sexual privacy, if there is surveillance, for example, under gambling tables, only women should watch, for obvious reasons. Even men do not like having their privacy invaded by other men.

Women also are more careful with details than men, who might blur opinion with evidence. This is compounded by the man's desire to get results, although the man may be unaware of his dishonesty.

Interrogation

For the same reason that men are impatient and like to get results, interrogation may best be carried out by women. Men feel humiliated when put down by another man, but are better able to take a slap in the face from a woman. So strong words from a woman may induce confession in many men.

Another reson why surveillance and interrogation are best carried out by women is that the few, very evil so called 'people', of the world are men. Stalin was a man. Although this does not fully eliminate the problem of women doing what these men tell them, it would improve the situation. I think the methods used by women should be agreed to by concerned men in general, but women should handle the details of each case by consultation among themselves.

Judgement

As men are better able to make decisions than women, the verdict should be decided by men, after examining the evidence from the women. Judges are better able to decide on innocence or guilt than an inexperienced jury. So if there is a jury, its only purpose should be to decide whether a judge is corrupt in his verdict.
